If your home is listed for Foreclosure, a Chapter 13 court protected repayment plan will stop the foreclosure dead in its tracks.
Of course, there are lots of methods that people try to stop their foreclosure– loan modification, forbearance, short sales, etc. But Chapter 13 is the only one that works every time.
In Chapter 13, you will be given the opportunity to get caught up on your mortgage payments over a three to five year period, with reasonable monthly payments.
As soon as you file for Chapter 13, the automatic stay serves to put an end to the foreclosure lawsuit. However, you must file your Chapter 13 before your home is sold at a foreclosure sale.
If you are dealing with the foreclosure of your home, please contact my office immediately via email or at (214) 740-1160 for a free, no obligation consultation at any of my Dallas area offices.
I’m on Workman’s comp and have been since October 5th 2010. Will be reevaluated on March the 1st to see if I need further therapy or go back to work. I’m a contract pipe fitter and was working for Tradesman International when I got hurt.
I’m being foreclosed on sale date March the 1st.
I got into a modification loan in November and they said they could help. I was $1,600.00 behind at the time.
They have been dropping the ball all over the place and still don’t have no results. Now I’m $3.000.00 behind and got a foreclosure from Ocwen. I have a double wide trailer on a acre of land.
First Atlantic says that they sent a court letter to the lawyers to say that I’m being refinanced but I’m worried. They said I had a underwriter, but they kept wanting me to resend documents that they said they never relieved so I sent it over and over. One lady said she was sorry this was happening that this is a case of one hand not knowing what the other hand is doing, that she will get on top of it.
What should I do. I don’t want to lose my place.
Unfortunately, I hear this same story 6 or 8 times every month. They say they’ve got an “underwriter” on it like that is some sort of magical event. Really, all it means is that they took a copy of the file and dropped it onto the desk of a part-time employee right out of high school, who can work through 2 files per day and has a backlog of 4,500 files…
I’m probably exaggerating a little. But not much!
There are lots of ways that people say they can stop your foreclosure. And all of these “solutions” cost a different amount. I’ve detailed all the different ways in a book that you can download for free. No obligation of course, but if you’d like a copy then let me know.
If they don’t give you something IN WRITING that the foreclosure sale has been pulled, you’ll end up filing a Chapter 13. If I eventually do that for you, it will 100% FOR SURE prevent the foreclosure.
(The reason I do Chapter 13′s instead of “modifications” or “forbearance” or any of that other “wishful thinking” stuff is because when done properly, Chapter 13 is the only one GUARANTEED to work.)
Now that they’ve posted you for foreclosure, you’re going to get bombarded with ads and fliers from all kinds of people. Some of them are legit and some of them are scammers.
If you end up wanting me to stop the foreclosure, I’ll be happy to do that. Just let me know by email or by calling my office at (214) 740-1160. You’ll want Extension “1″ which will be answered by Allison, who is my Appointments Coordinator and keeps my calendar. Allison will find whatever spots on my calendar are still open and can get one reserved for you. As we get closer to the foreclosure date, just let me know.
And, if there are other questions you’d like to ask in the meantime then please don’t hesitate to send them on over and I’ll get you some answers.
